Terms and Conditions

Performance Fuel Systems, Inc. reserves the right to refuse or cancel any order at any time. All sales are final. Your access to and use of performancefuelsystems.com, including any purchase made using our web site is exclusively governed by these terms and conditions and any others contained on this web site (collectively, Terms and Conditions), as may be supplemented by applicable law. By accessing, using or purchasing products form Performance Fuel Systems, Inc., you agree to be bound by the Terms and Conditions.

The Terms and Conditions may be changed at any time without prior notice. Changes will be made by modifying the web site. Your continued access to or use of the modified web site conclusively demonstrates your acceptance of those changes prospectively. We reserve the right to, at any time; discontinue products, change product specifications, prices, designs, features, models or equipment without incurring obligation.

No other provisions or changes are binding upon us unless reduced to writing and signed by an authorized Performance Fuel Systems, Inc. representative.

If any provision of the Terms and Conditions or any application thereof is held to be invalid or unenforceable for any reason, that provision shall be deemed severable and the remainder of the Terms and Conditions and the application of that provision in other situations shall not be affected.

All pictures herein are for representation purposes only. Although we do our best to provide as clear and accurate pictures as possible, the picture may be of a product similar to the actual one (i.e. different year, etc). Please reference the picture name since it usually is the same as the part number it corresponds to.

Performance Fuel Systems, Inc. reserves the right, without liability or prior notice, to revise, discontinue, or cease to make available any or all products or to refuse or cancel any order.

 

Policies

Order Changes/Cancellations 

All requests to change or cancel an order should be made by e-mail and sent to sales@performancefuelsystems.com. Please double check that your order is correct before clicking submit order.

Back Orders – Items temporarily out of stock will be placed on back-order unless you indicate that a refund should be made. All shipping charges on regular domestic orders are charged on the initial order, so back orders are shipped at no additional charge. Back ordered items usually are shipped within 30 days, however, availability can change and we reserve the right to cancel any back order and issue a refund.

Refused Shipments – The customer is responsible for freight both ways on any shipment for which delivery is refused. 

Sale Items – At no time are refunds given on items that may go on sale after purchase. Return policy

Returns will only be accepted within 30 days of the customer receiving the product and ONLY if a Return Merchandise Authorization (RMA) number has been issued. We reserve the right to refuse any package returned to us without authorization. Returns are generally processed with ten (10) business days of receipt. Business days do not include weekends, holidays, and the day the package is delivered.

We will not accept a return of an item that is damaged or defective if it has been used.

To obtain an RMA, go to Contact Us. Please include the reason for the return, date the order was placed, your order number, name, phone number, and shipping address.

Customers are responsible for checking all merchandise for damage or defect when the order is received, and before the item is used. If the product is damaged during shipment, Performance Fuel Systems, Inc. will replace the product at no charge. 

Products (including packaging) must be returned in new, resalable condition. If any component of the returned product is missing, the return procedure will be breached, and Performance Fuel Systems, Inc. may, in its sole and absolute discretion, reject the entire return or choose to impose additional charges against the customer for replacement of the missing component(s). The condition of the product will be determined at our discretion. Products sent back with damaged or missing packaging will be refused or returned to you at your expense. 

Any non-defective product returned for a refund will be assessed only the original shipping charges incurred by Performance Fuel Systems, Inc. A Damage and Recovery fee may be deducted if the returned merchandise is not resalable (i.e. damage to product, incomplete product, broken packaging, etc.). We will not assess a fee to returns of defective items. A qualified technician will test and review each returned product.

Customers are responsible for all return shipping charges unless they receive an incorrect (we shipped the wrong product) or defective item. In addition, if returning an item for a refund, the original shipping cost incurred by Performance Fuel Systems, Inc. will be deducted from the refund issued.

When shipping an item back to us, we recommend that you use UPS, FedEx or any other carrier that offers signature confirmation and insurance, as we are not responsible for lost or damaged packages. Additionally, only the signature of an authorized Performance Fuel Systems, Inc. employee will suffice as proof of delivery. The customer agrees to bear all shipping and insurance charges, and all risk of loss of returned product during shipment.

Performance Fuel Systems, Inc. is not responsible for any labor costs, which occur as the result of the installation of wrong or defective parts.

Unauthorized returns, refused shipments and undeliverable packages that are returned back to us can take up to three (3) weeks to be processed. The customer will be charged the original and the return shipping fees for any of these instances. If a return has not been processed within the specified time, please send an email to sales@performancefuelsystems.com.

Shipping Policy

Locations:

Performance Fuel Systems, Inc. ships to all locations in the Lower 48 states only. We do not ship to any international locations.

Shipping Methods:

Standard Shipping- All Standard Shipping orders will ship via UPS Ground. Performance Fuel Systems, Inc. will process all orders received the next business day (excluding weekends and holidays) after the order is received. We do not guarantee stock. If the item is currently available, the product will ship the day following the order date.

Damaged Shipments:

We try our best to prevent damage to all packages during transit by packing each order carefully.

If you receive an item that has been damaged in shipping, contact us immediately and we will have a new product sent to you, and initiate a UPS claim for the item.

Please be sure to hold on to the original packaging and packing material because UPS, in most case, will need to inspect the items. A UPS representative will contact you to set up a convenient time to inspect the item, and to pick it up. If UPS does not come to inspect the package, or does not take it with them when they do come, please call us, and we will send you a UPS tag to send the damaged product to us.

Undeliverable or Refused Shipments:

Packages will be returned to us if the package cannot be delivered due to incomplete or incorrect addresses, is not picked up from a UPS facility, or if the customer refuses delivery. All packages returned to us for the above reasons can take up to three (3) weeks to be processed and charged a restocking fee (the amount of which will be determined upon processing the refused item).

Warranty and Disclaimer of Liability

Performance Fuel Systems, Inc. expressly disclaims, and the purchaser expressly assumes, responsibility for any incidental or consequential damages arising from any and all product failure, sold through Performance Fuel Systems, Inc. Defective product liability is limited to the replacement or purchase price of the product. Any provision voided by state or other applicable law shall not act to enlarge other provisions of this warranty except as expressly required by law.

Our products are provided As Is. We do not make any representations or warranties, whether expressed or implied, regarding or relating to Performance Fuel Systems, Inc.

TO THE FULLEST EXTENT PRERMITTED BY LAW, OUR COMPANY DISCLAIMS ALL EXPRESSED AND IMPLIED WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OR MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

IN NO EVENT SHALL PERFORMANCE FUEL SYSTEMS, INC. OR ANY OF ITS EMPLOYEES, DIRECTORS, OFFICERS, AGENTS, VENDORS OR SUPPLIERS BE LIABLE FOR ANY DIRECT OR INDIRECT LOSSES OR DAMAGES ARISING FROM OR RELATED TO ANY PRODUCTS OR SERVICES PROVIDED HEREIN.

This limitation of liability applies to all losses and damages of any kind whatsoever (whether general, special, consequential, incidental, punitive, exemplary, or otherwise, including loss of income, profits, or data), whether arising in contract, negligence or other tort theory, even if we have been advised or should have known of the possibility of such losses or damages.

The preceding Warranty Disclaimer and /or Limitation of Liability shall survive the failure of any exclusive remedy, but they may be prohibited or restricted by applicable law so they may not apply to you.

YOU AGREE TO INDEMNIFY, DEFEND AND HOLD HARMLESS PERFORMANCE FUEL SYSTEMS, INC. OR ANY OT ITS EMPLOYEES, DIRECTORS, OFFICERS, AGENTS, VENDORS OR SUPPLIERS FROM AND AGAINST ANY AND ALL THIRD PARTY CLAIMS, DEMANDS, LIABILITIES, COSTS OR EXPENSE, INCLUDING REASONABLE ATTORNEYS’ FEES, ARISING FROM OR RELATED TO ANY BREACH BY YOU OF ANY OF THE TERMS AND CONDITIONS OR APPLICALBE LAW, INCLUDING THOSE REGARDING INTELLECTUAL PROPERTY.

Performance Fuel Systems, Inc. considers the personal information you choose to share with us to be confidential. We do not share any personal or identifying information you submit through our web site with any unaffiliated third party, unless it is necessary to respond to your inquiry or required by law.

We train our associates to respect and protect our customers’ privacy. We limit our associates’ access to information about you, and stress the importance of your privacy with our associates.

If you just view our web site, we do not collect any personal or identifying information about you. We do monitor the number of visits to our web site, but only in the aggregate. This information is important for us to provide the best possible service to you.
